Recommendations to the Administration
Regarding the Principle
In order for the administration to act in accordance with the principle of
proportionality, it must consider the following points:
➢ While making decisions, the administration must ensure using the
most appropriate means to achieve the legitimate and pursued aim.
➢ The administration must determine all alternatives to achieve the
goal before establishing its actions and proceedings and if there is
more than one method or tool it can use to carry out its proceedings
and actions, it shall choose the option that involves minimal
intervention in the freedoms and interests of individuals.
➢ In order to achieve the determined goal, the procedure that
is established by the institution must pose an acceptable and
reasonable necessity.
➢ The administration must respect the principle of proportionality
while intervening in the rights, freedoms and interests of individuals
and must maintain a fair and just balance between the intervention
and the general public interest.
➢ The administration’s intervention in the rights, freedoms and
interests of individuals shall not have a nature that would completely
eliminate the exercise of their rights or damage the essence of their
rights.
➢ It is essential to maintain the balance of interests among individuals
in the procedures established by the administration.
