Manual On Good Administration Principles
“Commit yourselves to examining the situation of the
poor and needy who do not have the opportunity to
lodge a complaint against a maladministrative practice
to you in person and of those who are unaware of the
legal remedies. Assign a trustworthy official to the
investigation of the complaints and fulfilment of the
needs of those people.”
Tahir Ibn. Hussein
(776-822, the Founder and First Ruler of Tahirid Dynasty)
onclusion of an application to the administration by individuals within an
Cadmissible time frame taking sui generis aspect of the application means
reasonable time limit for taking decisions. As the determination of such a time
frame individually for every application is difficult, it is important to conclude
every proceeding within the shortest period of time possible by considering the
characteristics of each of the applications.
The principle of reasonable time limit for taking decisions include the following:
Compliance with the deadlines set for the applications to be concluded
in the legal arrangements,
In the event that a time limit for taking decisions is not specified,
completion of the process as quickly as possible according to the
characteristics of the application,
Non-extension of the time for taking decisions deliberately, arbitrarily
or negligently.
Legal Basis
Article 7 titled “Examination of the Petition and Notification of its Result”
of the Law on the Exercise of the Right to Petition” No.3071 includes the
time limit for the conclusion of the applications duly made and of the
petitions written by the individuals and legal entities relevant to the public
and themselves. As per the article in question, “petitioners are responded
with justifications in thirty days at the latest about the application results
on the requests and complaints relevant to the public or themselves by
Turkish citizens and foreign nationals residing in Turkey, about the phase of
the ongoing proceedings. If the phase of the proceedings is declared, the
result of the application is separately notified.”
