Let me just say a few remarks after of course thanking my colleagues
               for agreeing to be on the panel, I see my task as chair of the panel
               to also facilitate a potential discussion. So that has one positive and
               one negative results. The negative is that I am asked to try and keep
               our time and I ask my colleagues to excuse me if I intervene with the
               request that they observe the time limits. When I was a very young
               professor  in  my  early  thirties  I  went  to  a  major  conference  in  the
               United States and the chairman of the panel became ill and I was of
               course asked to chair and next to me was a very famous professor of
               political science and I gave him the floor and he started talking and
               the time passed and he kept talking, I passed him a little note and he
               kept talking at one point I went to him and said, “the time” and he said,
               “Young man! It is my business to talk, if you do not stop me I will keep
               on talking”. So, I will try and apply that principle and we will proceed
               in the order which the programme has been arranged so I will give
               the floor first to our colleague the Ukrainian Parliament Commission
               of Human Rights, Mrs., Valeriya Lutkovska and I will also at the end
               of each presentation make some comments designed to be able to
               facilitate discussion afterwards, Okay? Go ahead, you have the floor.

          VALERİYA LUTKOVSKA (Ombudsman of Ukraine)

               Thank you Chair and first of all thank you very much Chief Ombudsman
               of  Turkey  for  the  invitation  for  this  important  and  very  interesting
               symposium.
               My  theme  is  the  mandate  of  the  ombudsman  of  Ukrainian  juridical
               procedure, it is really very interesting question because in accordance
               with our constitution, justice in Ukraine must be administrated exclusively
               by the court. Delegation of the functions of the court and exercise of this
               function by others officials shall not be permitted. Influencing judges in
               any manner is prohibited. The judges are independent and subject to
               rules of the law. In accordance with the legislation about the work of
               ombudsperson and in accordance with our law about ombudsperson,
               ombudsperson of Ukraine must close the procedure if this procedure
               was opened in our office and must not open the procedure if the person
               applies to the court with same question like the ombudsperson. So, the
               question is how can ombudsperson be effective in the question of court
               procedure because the application concerning the violation of human
               rights we received very often.
