conducting the investigation had his/her opinion in advance and revealed
it by signing the punishment report to be given to the plaintiff association
of undertakings, it was concluded that the principle of impartiality was
breached since the same member attended and voted at the meeting in
which the report was supposed to be discussed and evaluated objectively
as a result of which the final decision would be made.
Recommendations to the Administration
Regarding the Principle
In order for the administration to act in accordance with the principle of
impartiality, it must consider the following points:
➢ The administration should act impartially in all actions, procedures,
attitudes and behaviours, except in cases where positive discrimination
will be applied, and should not decide in favour of or against a
person solely on the basis of language, race, color, gender, political
ideology, philosophical belief, religion or religious doctrine and similar
characteristics.
➢ The officials should not act with personal, economical, family etc.
interest while performing their duties in the administration.
➢ The administrative authority should not take part in any decision or
process that directly or indirectly favours the interest of himself or of
any relative.
➢ The officials should act with integrity in all their activities. In this
regard, they should not express their opinions about an individual or
the application of the individual prior to concluding a decision; any
actions that cast a shadow on the impartiality of the administration
should be avoided.
➢ Public officials should not only be impartial in their decisions but
should act in integrity in all transactional processes and attitudes, and
should abstain from any actions that may raise suspicion about their
impartiality.
➢ The officials should stay away from conflicts of interest pursuant to
the principle of impartiality and the administration should exercise
due diligence to implement the necessary legal or administrative
arrangements in order to prevent these conflicts.
