with the procedure set forth in the law, and under judicial supervision.”,
which imposes the obligation of “ensuring integrity in relations among its
members and with the public” exclusively on the professional organisations
having the characteristics of public institutions.
Article 1 titled “Purpose and Scope” of the Law No. 5176 on Establishment of
Council of Ethics for Public Service and Making Amendments on Certain Laws
lays out the purpose of the Law, which is to determine the establishment,
duty and working procedures and fundamentals of the Council of
Ethics for Public Service as to adopt and observe the implementation
of ethical attitude principles such as transparency, impartiality, honesty,
accountability, which should be abided by the public officials.
Article 9 titled “Honesty and Impartiality” of the By-Law on Code of Ethics
for Public Servants and Application Procedures and Principles sets forth
that public officials shall act in line with the principle of honesty in all its
actions and proceedings.
Article 6 titled “Honesty” of the By-Law on Code of Ethics and Professional
Conduct for Inspectors lays down that inspectors shall carry out their
proceedings in a sense of honesty, integrity, diligence and responsibility;
shall not make promises or commitments on the duties of others relevant
to the inspection and investigation; shall avoid images, attitudes and
behaviours that may damage their dignity and reliability; shall carry out the
task within the scope and time assigned thereto; shall notify the competent
authorities when they learn criminal acts and actions.
Another important legal arrangement in Turkish legislation is the Law
No. 3628 on Declaration of Property, and Combat Against Bribery and
Corruption, issued to combat corruption and prevent bribery as a
requirement of the principle of honesty and the By-Law on Declaration
of Property, published in accordance with this Law. The Law and By-Law
regulate declaration of property by those listed in this Act, renewal of
declarations, supervision of acquisition of property, provisions applicable
in case of unjust acquisition of property and false declaration, and follow
up and trial procedure for public officials and accomplices due to crimes
specified in this Act and some crimes. The Law and By-Law emphasise that
goods which cannot be proved to have been provided in accordance with
law and public morale or increases revealed as expenses which cannot
be considered commensurate with the income of the concerned in terms
of the social life of the concerned are considered unjust acquisition of
property.
Article 11 of the European Code of Good Administrative Behaviour covers
the principle of “fairness”. According to this principle, “The official shall act
impartially, fairly, and reasonably.”, which expresses that the administration
should comply with the principle of honesty in its behaviours towards the
citizens.
