nistry of Justice.
I have question to the Slovenian Acting Ombudsman; you said that you
act like a legal way of remedy once all legal ways including individual
recourse are exhausted. Is this a binding remedy from the view point
of the executive branch or an opinion of advisory nature? Furthermore,
control and auditing of the state bodies and checking compliance with
law, are they of advisor nature?

Yes, according to the law we can enter any state institution but you also
act as a national preventive mechanism in relation to this convention
against torture and within this role as a national preventive mechanism
we can enter also to the private institutions, care homes for elderly
and so on or private hospitals also. But the right to petition is special 3 rd INTERNATIONAL SYMPOSIUM ON OMBUDSMAN INSTITUTIONS
constitution right in my country and we advocate in our annual report
every year that this right should be further regulated by the law because
nowadays we are maybe the only institution which we ask that every
petition, every letter should be answered because sometimes state
institution doesn’t answer and it is not regulated even if it is constitution
right or human right in my country. I hope I’ve answered your question.

CHAIR: From these examples, we understand how efficient and practical
an Ombudsman institution must be. Let me briefly wrap up the talks and
share a couple of suggestions.
If we are expecting much more efficient auditing from the Ombudsman, I
believe some changes must take place in Turkish Ombudsman Institution.
First suggestion is about paragraph 4 of Article 17.
