                  Only  few  words,  thank  you  very  much  Chief  Ombudsman  for  your
                  assessment of my presentation. I think that is very important to find
                  this boarder between the independency of justice for concrete judge
                  and  between  our  obligations  to  protect  human  rights  even  in  the
                  sphere of the procedure. So, it is very important and I think that we can
                  have some influence to the justice if we solve the violation of human
                  rights. Thank you.


                  CHAIR: Thank you very much, again as I said before we assume balance in
                  the interest of fairness and gender balance, you have the floor.

            JUSTICE NASER SERAJ (Ombudsman of Iran)
                  Yes,  the  complaints  come  through  the  telephone,  website  or  by  the
                  presence of the person and the General Inspector of the Iran if it is related
                  to the criminal act it will sent to the court and the judge is oblige to answer
                  and also issue the decree within three months. And based on the Article
                  174 the inspection organization is responsible for good conduct of law
                  and affairs and implementation of law. And the reports maybe would be   3 rd  INTERNATIONAL SYMPOSIUM ON OMBUDSMAN INSTITUTIONS
                  based on the neglects, negligence or maybe some wrong decision of the
                  government so based on that it will be sent to the administrative court of
                  law and if it is not based on that it would be rejected.
                  If  it  is  the  administrative  negligence  it  would  be  rejected  from  the
                  administrative department or maybe some sort of punishment based
                  on  law.    The  judges  in  Iran  are  very  independent  and  there  are  no
                  officials  or  authorities  do  not  have  right  to  interfere  to  the  judge’s
                  decision.  And  the  fourth  question  is,  the  judges  do  not  have  the
                  right to enter to the politics and based on the law it would be clear
                  that the judge just have a decision politically it will be rejected from
                  administrative department. Thank you.
