Manual On Good Administration Principles
Another important document on good administration is the Charter of
Fundamental Rights of the European Union, which was adopted on 7th
December 2000. Within the scope of various articles of the Charter, principles
relevant to good administration are regulated; in particular, Article 42 regulates
the Right to Good Administration. For example, Article 8 is on the protection
of personal data, Articles 20 and 21 are about equality and absence of
discrimination respectively, Article 41 is on Right of Access to documents and
Article 44 regulates the Right to Petition.
Another significant document on good administration is the European Code of
Good Administrative Behaviour adopted in 2001 by the European Parliament,
which was prepared by the European Ombudsman based on the decisions of
the European Court of Justice and on the cases seen in the maladministrative
practices
In this introduction part of the Code, it is stated that the objective of the Code
is to help citizens to know what administrative standards they are entitled to
expect from the EU institutions and to encourage the highest standards of
administration by making the principle of good administration more concrete.
The other important legal document on good administration is the
Recommendation no. CM/REC 2007/7 of the Committee of Ministers to
member states on good administration. The Recommendation encourages the
development of the right to good administration in a way to provide benefits
for all.
