Manual On Good Administration Principles
With the amendment made in Article 74 of the Constitution in 2010, it
has been introduced that everyone has the right to obtain information
and appeal to the Ombudsman; following thereof, establishment of the
Ombudsman Institution, which examines complaints on the functioning
of the administration, under the Grand National Assembly of Turkey, has
been set forth.
Articles 125 and 129 of the Constitution were amended in 2010, as
well. Accordingly, recourse to judicial review shall be available against
all decisions taken by the Supreme Military Council regarding expulsion
from the armed forces except acts regarding promotion and retiring due
to lack of tenure. Furthermore, disciplinary decisions including legal
warning and notice of reprimand, which were exempt from judicial
review before, shall not be exempt from judicial review anymore.
With the amendments made in Article 148 of the Constitution in 2010,
everyone may apply to the Constitutional Court on the grounds that one
of the fundamental rights and freedoms within the scope of the European
Convention on Human Rights which are guaranteed by the Constitution
has been violated by public authorities on the condition that ordinary
legal remedies have been exhausted.
With the amendments made in the Constitution in 2017, the infrastructure
for transition to the Presidential government system has been created.
3.2. Legal and Lower Level Developments,
Restructuring of Existing Institutions and
Formation of New Institutions
Law on the Right to Information was issued and Right to Information
Assessment Board was established with a view to regulating the principles
and procedures on the exercise of the right to information in accordance
with the principles of equality, impartiality and openness, which are the
requirements for a democratic and transparent administration, and
ensuring the access to information produced by the public institutions
and organisations.
With the Law No. 5176 on Establishment of Council of Ethics for Public
Service and Making Amendments on Certain Laws, a code of conduct
for public servants including such principles as transparency, impartiality,
honesty, accountability, protection of public interests was set forth and
the Board of Ethics for Public Servants was established.
