PROF.  AYDIN  GÜLAN-  A  debate  between  the  recommendations  of  the
                  Ombudsman intuitions and the judiciary will be clarified in time, upon
                  new verdicts or judgements. I do not think that this is an issue that can
                  be resolved by a legislative arrangement. The Ombudsman decision
                  determining the meaning and the scope of the judgement that I have
                  given as an example does not pose to an intervention into the power
                  of judiciary that is for sure. Ombudsman evaluates the transactions
                  and the actions to be engaged by the public administration vis-à-vis
                  a recommendation of the Ombudsman instruction. Hence, this area
                  will  be  clarified  regarding  the  power  of  judiciary,  final  resolution  of
                  a  dispute,  convergence  or  conflict  between  a  dispute  that  is  to  be
                  resolved by judiciary and the one to be resolved by ombudsman once
                  further  decisions  or  recommendations  come  up.  There  are  many
                  points that will not be exposed to such a conflict whereas certain issues
                  may be intertwined with each other. Instead of clearly regulating this
                  area, through decisions and resilience about the principle of fairness,
                  the practice shall determine the course.

                  Ombudsman was able to stay with us I will take the opportunity to first
                  of all thank the panelist for their contributions to this particular session. I
                  will say that I found it to be a very rich session and I am very grateful to all
                  those who asked questions for making it a rich session.
                  And I will proceed again one more time to say that I am sure that I am
                  speaking  for  all  of  you  in  extending  our  grateful  thanks  to  the  Chief
                  Ombudsman of Turkey for having convened for a 3  year this particular

                  symposium. I will speak personally and I will say selfishly that I hope you
                  will do a 4  one and invite me again. And I am sure many of you would like
                          th
                  to see the same treatment so let us then thank the Chief Ombudsman and
                  his staff for having organized a wonderful conference. Let us also thank
                  the interpreters for doing this extremely important work which allows us to
                  communicate among one another for their superb work and generally the
                  ombudsman institution and wish you all god luck. Thank you again.
