foreseen by regulations and this is important also for discrimination
cases I think. According to the constitution act the ombudsman is also
entitled to initiate a procedure for the review of the constitutionality
or legality of regulations or individual constitutional complaint in
agreement with the effected party. In both cases ombudsman hold
authorize position of applicant since we are obliged to prove legal
interest as individual case to prove legal interest. And we use both
this options only in especially well founded cases in order to avoid
becoming additional legal remedy for those who have already
exhausted all regular complaint routes. So, we go the constitution
court in very exception cases and I will mention only one case from last
year’s mainly about four years ago our government introduced the law
which reduced the pensions of the special categories of pensioners.
Mainly some veterans pensions were reduced other not. And we
challenged this law before constitution court and we were successful
and the government had to change the law and pensions almost
70,000 of them were giving back the pensioners which were reduced
according to this and constitution discriminatory law.
We are also entitled to present initiative before the parliament by
recommendations to state authorities. I will now explain very briefly
our practice I think which is very good how annual report is debated
in the national assembly. It takes many years that the members of the 3 rd INTERNATIONAL SYMPOSIUM ON OMBUDSMAN INSTITUTIONS
parliament understand how to use our annual report to their benefit
and how to be effective in dealing with after debating the annual report.
Namely, we propose recommendations in our annual report for state
institutions and when annual report is debated the government is
obliged to present their own report on our annual reports. So, they
reply on every chapter of our annual report and they also have to
report how recommendations from the last year were implemented
by the state institutions. So, next year when annual report is debated
they already have this government report on implementation of
recommendations from the last year. And usually it takes about six-
seven hours in the plenary to debate our annual report and these
days the committees in our national assembly started to debate our
annual report for 2014. Very few numbers we receive about 3500
complaints every year. We are 35 and if you compare the number
of complaints with our population which is 2 million in Slovenia we
receive about 16 to 17 complaints per 10,000 inhabitants. And this is
